法國是大陸法系國家的代表性國家，也是法國法系的母國。我國的民事立法，從立法技術到法律理念，均曾受到法國法的影響。雖然近年來德國法學某種程序上對我國影響日深，但就國民性格與司法風格而言，在大陸法系諸國中，我國與法國亦較為接近。我國現行法中關于不當得利之立法相當簡略，加之對不當得利的研究薄弱，在實踐中出現了對不當得利訴訟的濫用，在我國的民法典的制定過程中，對不當得利亦未予以足夠重視。因此，以國際化的視野、比較法之方法了解法國不當得利法的歷史與現狀，不僅對于豐富我國民法理論具有一定意義，對于我國民法典的立法亦不無鏡鑒。希冀在我國的民事立法、司法中，能對不當得利法予以充分的重視和科學的研究，以使我國民事立法及司法更趨科學。
