麥克米倫法學精要叢書是麥克米倫近年來重點推出的一套法學教
材。風格明晰簡約,內容深淺適中。叢書以方便學生學習為目標,闡發
原理,評介法律;析解制度,品讀案例;引導思考,提供練習。既適用于
專業課程的學習,也有助于職業技能的改進,受到學生與教師的廣泛歡
迎。對我們非英語國家的學生和研究者來說,這樣一套教材恰好是學
習、了解英語國家法學和提高法律英語水平的極好讀物。
法律出版社作為中國最大的法律圖書出版機構,一直致力于法律
圖書的全品種出版。2002年,成立專門的法律教育出版中心,將服務

叢書,受到佳評。如今,我們再次引進這套麥克米倫法學精要叢書,影
印出版,期冀在中文教材之外,為廣大學子和研究人員進一步提供優秀
英文教材讀物,謹獻綿薄之力,給進步中的中國法治事業和進步中的中
國年輕一代。
這本由喬·肖編著的《歐盟法》(第三版)是一本為法學、政治學學生
提供的學習歐盟法的入門教科書。與同類的教科書相比,本書有以下
幾個特點:
1.通俗、簡明、視野開闊。歐盟法是一個自成一類的法律體系,突
破了傳統的國際法與歐洲國內法的界限。要學習、研究好歐盟法,不但
要求具備國際法和歐洲國內法的知識和訓練,還需對歐洲的政治、經
濟、社會、文化等各方面有所了解,否則不易理解法律規則背后的東西
和規則產生的原因。在這一繁復的知識領域面前,本書作者沒有故作
高深,而假定讀者事先沒有受過任何歐盟法的訓練,從而以通俗的語言
介紹和解讀歐盟法。同時,作者并未就條文談條文,而將法律條文放到
更廣闊的政治、經濟、社會和文化大背景下進行分析。
2.資料翔實、精煉。從1951年歐洲煤鋼共同體成252今,歐洲一
體化已經走過五十多年曲折、艱苦的歷程。在這個過程中,學術界起到
了很大的推動作用,各種學術研究成果浩如煙海。本書在選取主要參
考書目與文章時,顯然頗費心思——精心選擇了大量1990年代以后優
秀學者的代表著述,并收錄了部分1990年代以前這一領域不可不提的
經典,例如P.Pescatore在1983年發表的“TheDoctnneOf‘Direct Ef-
fect’:Anlnfant Disease in Community Law"。另外,歐盟法網上資源十
分豐富,本書許多章節都附有主要的查閱網址。
3.重點放在歐盟憲法和行政法。歐盟法基本可以分為三大部分:
憲法和行政法、經濟法和對外關系法。本書主要研究和討論的是歐盟
憲法和行政法方面的問題。作者假定該書的讀者多數來自英國和其它
歐盟成員國,他們最關心的問題正是關系到歐盟成員國及其國民切身
利益的憲政問題。
值得一提的是,學習、研究歐盟法的一個困難是它的時效性較強。
夸張一點說,今天是法,明天一覺醒來就可能不再是法。這是由于歐洲
一體化本身的發展所致。學習、研究歐盟法應當在教材的基礎上,十分
關注歐洲一體化本身的發展,經常更新自己的數據庫。
